This Acceptable Use Policy (“AUP”) governs the use of all services provided by COLONELSERVER, registered in the Netherlands under Chamber of Commerce number 96072377 (“COLONELSERVER”, “we”, “us” or “our”).

By purchasing, accessing or using any COLONELSERVER service, the Customer agrees to comply with this AUP. This AUP forms an integral part of the COLONELSERVER Terms and Conditions.

1. Scope

This AUP applies to all COLONELSERVER services, including but not limited to:

Shared and reseller hosting
WordPress and application hosting
Virtual Private Servers (VPS)
Dedicated and bare-metal servers
Cloud infrastructure
Colocation and network services
Domain-related services
Software licences and managed services
IP-adressen, bandwidth and other network resources

This policy applies to Customers, account users, beheerders, employees, contractors, wederverkopers, sub-users, end users and any other person who accesses or uses a service provided through a Customer’s account.

The Customer is responsible for all activity conducted through its account and services, including activity performed by third parties, sub-users, klanten, scripts, applications or compromised systems.

2. Permitted Use

COLONELSERVER services may be used for lawful business, personal, ontwikkeling, mededeling, storage and hosting purposes, provided that the use:

Complies with this AUP and the COLONELSERVER Terms and Conditions
Complies with all applicable local, national and international laws
Does not infringe the rights of COLONELSERVER or any third party
Does not interfere with the security, availability or integrity of any network, system or service
Does not expose COLONELSERVER, its infrastructure, suppliers or third parties to legal, regulatory, security or reputational risks
Remains within the technical and resource limits applicable to the purchased service

Customers must obtain all licences, permissions and regulatory approvals required for their activities.

3. Prohibited Use

Customers may not use COLONELSERVER services directly or indirectly for any of the following activities.

3.1 Illegal or unlawful activity

Violating applicable laws, regelgeving, court orders or governmental requirements
Facilitating, encouraging or concealing criminal activity
Selling or distributing illegal goods, controlled substances or unlawfully obtained materials
Human trafficking, exploitatie, terrorism or violent extremist activity
Content or activity that promotes or provides instructions for serious criminal conduct
Circumventing legal restrictions, regulatory requirements or law enforcement measures

3.2 Child exploitation and harmful content

Child sexual abuse material or any sexualised content involving minors
Grooming, exploitation or endangerment of children
Non-consensual intimate content
Content involving sexual violence, coercion or exploitation
Content that unlawfully encourages suicide, self-harm or violence against others

Any suspected child sexual abuse material may be reported immediately to the relevant authorities without prior notice to the Customer.

3.3 Intellectual property violations

Hosten, distributing or making available content that infringes copyright, handelsmerken, patents or other intellectual property rights
Operating services primarily intended to distribute infringing content
Distributing pirated software, licence keys, cracks, torrents, magnet links or unauthorised copies of protected works
Intentionally using a third party’s brand, identity or trademark without authorisation

3.4 Fraud, phishing and impersonation

Phishing, credential theft or collection of authentication information under false pretences
Financial fraud, payment fraud, investment scams or advance-fee schemes
Identity theft or impersonation
Creating deceptive websites, toepassingen, messages or documents
Pyramid schemes, Ponzi schemes or fraudulent multi-level marketing
Forging email headers, caller identity, network information or other identification data

3.5 Malware and unauthorised access

Developing, hosten, distributing or controlling malware, ransomware, spyware, virussen, Trojan horses or other malicious software
Operating botnets, command-and-control infrastructure or malware distribution systems
Attempting to access accounts, computers, apparaten, networks or data without authorisation
Brute-force attacks, credential stuffing or automated password attacks
Port scanning, vulnerability scanning or penetration testing without the explicit authorisation of the system owner
Exploiting or attempting to exploit security vulnerabilities
Hosting tools or infrastructure primarily intended to facilitate cyberattacks

Legitimate security testing is permitted only when the Customer has documented authorisation from the owner of the target system and the activity does not affect COLONELSERVER or third-party infrastructure.

3.6 Network abuse

Denial-of-service or distributed denial-of-service attacks
IP spoofing, MAC spoofing or transmitting traffic using IP addresses not assigned or authorised for the service
Unauthorised route announcements, proxy ARP, DHCP, multicast or redundancy protocols on shared networks
Traffic interception, packet manipulation or unauthorised surveillance
Activities that degrade or disrupt COLONELSERVER systems, upstream providers or third-party networks
Excessive packets per second, connection floods or other abusive traffic patterns
Evading network restrictions, abuse controls or service limitations

3.7 Spam and messaging abuse

Sending unsolicited bulk email or commercial electronic messages
Operating open mail relays or insecure mail systems
Sending messages to purchased, harvested or non-consenting recipient lists
Email bombing, snowshoe spamming or distributing spam through compromised accounts
Hosting websites, redirectors or landing pages promoted through spam
Using misleading sender information, subject lines or reply addresses
Continuing to send messages after recipients have withdrawn consent

Customers operating mail services must maintain appropriate consent records, unsubscribe procedures, authentication and abuse handling processes.

3.8 Privacy and personal data violations

Collecting, processing, publishing or selling personal data without a lawful basis
Publishing private or confidential information without permission
Unlawful monitoring, tracking or surveillance
Violating the General Data Protection Regulation (AVG) or other applicable privacy laws
Hosting databases or datasets obtained through breaches, theft or unauthorised scraping

3.9 Sanctions and restricted parties

Customers may not use COLONELSERVER services in violation of applicable sanctions, export controls, trade restrictions or anti-money laundering laws, including applicable sanctions imposed by the European Union, the United Nations and the Netherlands.

Services may not be used by, for the benefit of, or on behalf of any person, organisation or entity where providing such services would be prohibited by applicable law.

Customers may not use false information, intermediaries, wederverkopers, payment methods or technical measures to evade sanctions or geographic restrictions.

COLONELSERVER may request identity, eigendom, source-of-funds or business activity information where reasonably required for compliance purposes.

4. Restricted and High-Risk Activities

The following activities require prior written approval from COLONELSERVER and may be refused at our discretion:

Public or commercial VPN, volmacht, tunnelling or anonymisation services
Public file, image or video sharing platforms
High-volume streaming or content distribution services
Cryptocurrency mining or other continuous high-load computing
Cryptocurrency exchanges, mixers or financial trading platforms
Gambling, betting, lottery or gaming services involving monetary value
Adult or sexually explicit content
Pharmaceutical, medisch, weapons or other regulated marketplaces
Bulk email or commercial messaging platforms
Security scanning, penetration testing or vulnerability research infrastructure

Approval may be subject to additional verification, technical restrictions, monitoring or contractual conditions. Receiving approval does not exempt the Customer from applicable laws or this AUP.

Cryptocurrency mining is prohibited on shared hosting and VPS infrastructure unless COLONELSERVER has expressly confirmed otherwise in writing.

5. Technical and Resource Usage

Customers must use allocated resources responsibly and in accordance with the technical limits of their service.

The following are prohibited:

Sustained excessive CPU, geheugen, opslag, schijf-I/O, network or process usage that negatively affects other customers or shared infrastructure
Circumventing resource limits or usage measurement systems
Unauthorised overclocking or modification of hardware, GPU, BIOS, firmware, IPMI or network settings
Running unlicensed software
Using operating systems or software without the licences required by their publishers
Interfering with monitoring, security or management systems
Using more IP addresses, MAC addresses or network resources than assigned
Attempting to conceal the origin, destination or nature of network traffic

COLONELSERVER may apply reasonable technical restrictions to protect its infrastructure, suppliers and customers.

6. Security Responsibilities

Customers must:

Use strong and unique passwords
Enable multi-factor authentication where available
Keep operating systems, toepassingen, plugins and scripts updated
Remove unsupported or vulnerable software
Secure administrative interfaces and remote access services
Prevent their services from being used for abuse
Maintain appropriate backups
Investigate security incidents promptly
Notify COLONELSERVER if an account or service may have been compromised
Cooperate with reasonable security, identity and abuse investigations

A compromised server or account does not relieve the Customer of responsibility for activity originating from the service.

COLONELSERVER may temporarily isolate or suspend a compromised service where necessary to prevent ongoing damage.

7. Wederverkopers, Sub-Users and Third Parties

Customers who resell, share or provide access to COLONELSERVER services remain responsible for all activity performed by their customers, users and other third parties.

Resellers must:

Ensure their customers comply with this AUP
Maintain accurate customer and contact information
Provide an effective abuse reporting process
Promptly forward and respond to abuse complaints
Suspend or terminate abusive users where required
Cooperate with COLONELSERVER investigations
Maintain terms that are no less protective than this AUP

A Customer may not avoid responsibility by claiming that prohibited activity was performed by a customer, contractor, visitor, sub-user or other third party.

8. Monitoring and Investigation

COLONELSERVER does not generally review or control Customer content before it is published. Echter, to protect its services and comply with legal obligations, COLONELSERVER reserves the right to:

Monitor network and resource usage
Use automated systems to detect spam, malware, aanvallen, fraud and abnormal traffic
Review relevant system, authentication and network logs
Investigate complaints and suspected violations
Request information, identification, logs or evidence from the Customer
Share relevant information with upstream providers, data centres, payment providers, regulators or competent authorities where legally required or reasonably necessary
Preserve relevant data or evidence in accordance with applicable law

Customers must not obstruct, mislead or interfere with an investigation.

9. Enforcement

COLONELSERVER determines the appropriate response to an AUP violation based on its nature, severity, urgency, history and potential impact.

Enforcement actions may include:

Issuing a warning or requesting corrective action
Blocking specific traffic, havens, IP-adressen, domains or applications
Restricting access to part of a service
Temporarily isolating or suspending a service
Removing or disabling access to prohibited content
Requiring additional verification or security measures
Terminating the affected service or Customer account
Refusing new orders or future services
Preserving evidence and notifying relevant authorities or affected third parties
Charging reasonable investigation, remediation or reactivation costs where contractually permitted

Where a violation creates an immediate security, legal or operational risk, COLONELSERVER may take action without prior notice.

Where reasonably possible and appropriate, the Customer will be given an opportunity to correct a violation. No prior warning is required for serious, repeated or deliberate violations, including malware, phishing, fraud, child exploitation, aanvallen, sanctions violations or activity that threatens the security or availability of any system.

Services suspended or terminated for violation of this AUP may not be eligible for a refund, in accordance with the COLONELSERVER Terms and Conditions and Refund Policy.

10. Abuse Reports

Suspected abuse involving COLONELSERVER infrastructure should be reported through our published abuse contact or support system.

Reports should include, where applicable:

The relevant IP address or domain
Date, time and timezone of the incident
Source and destination ports
Complete email headers
Relevant URLs
Log files or other technical evidence
A clear description of the alleged violation
Contact details of the reporting party

COLONELSERVER may request additional information where necessary to verify and investigate a report.

Customers must maintain valid contact information and respond promptly to abuse and security notices. Failure to respond or take corrective action may result in suspension or termination.

11. Changes to this Policy

COLONELSERVER may update this AUP to reflect changes in its services, applicable laws, security requirements or industry practices.

The current version will be published on the COLONELSERVER website. Continued use of the services after an updated AUP takes effect constitutes acceptance of the revised policy.
